Terms of Use
This page describes the terms governing the use of materials from the safeguarding portal, published on the website https://www.safeguarding.caritas.ua (hereinafter, the Portal), and developed by the International Charitable Foundation “Caritas Ukraine” or with its participation.
General Terms
1.1. Users of the Portal and/or its mobile version, RSS, API, software, content, and other files (hereinafter – the Portal) placed on it, particularly by registering their account, agree to comply with all terms outlined in these Terms of Use (hereinafter, the Rules). A user of the Portal is a person who has access to the website https://www.safeguarding.caritas.ua, its software, and the materials published on it.
1.2. All users of the Portal are obliged to familiarize themselves with these Rules before each use of the Portal. If a Portal user has questions or doubts regarding the provisions of these Rules, they can request clarification by contacting secretary@caritas.ua.
1.3. Caritas Ukraine may, if necessary, change the terms outlined in these Rules, and such changes become effective immediately upon their publication on the website. If a user continues to use the Portal after the amended Rules are published, it signifies their consent to comply with the Rules and all its changes.
1.4. If any terms of these Rules or their changes are unacceptable to the user, they may not start or may cease using the Portal. Use of the Portal and any information posted on it is prohibited if these Rules are not accepted.
2. Portal Materials
2.1. This Portal is publicly accessible, and any information presented on it is not considered confidential. Registration is required to access materials that require restricted access.
2.2. All materials published on the Portal, including but not limited to: texts, documents, presentations, videos, illustrations, news, etc. (hereinafter, Materials or Content) are protected by copyright and are owned by Caritas Ukraine. Users must comply with all additional copyright notices and restrictions contained on any page of the Portal.
2.3. The Content of the Portal is protected by copyright in accordance with the legislation of Ukraine and international copyright law. Users do not have the right to modify, publish, transmit, participate in the transfer or sale, reproduce, create new works, distribute, perform, or in any way use the content of the Portal (including software) in whole or in part (except for cases provided for in clause 2.3 of these Rules).
2.4. Terms of use of Portal Materials:
2.4.1. Use of Portal Materials by downloading and subsequent use is allowed exclusively for:
- member organizations of the Caritas Ukraine network;
- educational institutions, social institutions, public and charitable organizations, other legal and natural persons who carry out educational activities and are engaged in the protection of children and vulnerable adults on a non-commercial, non-profit or charitable basis;
- personal non-commercial use by individuals for the purpose of deepening knowledge in the field of safeguarding, protection of children and vulnerable adults.
2.4.2. The content of the Portal should not be used in activities unrelated to safeguarding, protection of children and vulnerable adults or in covering topics that may have a negative reputational impact on Caritas Ukraine or member organizations of the “Caritas” network, including for marketing purposes, branding, etc.
2.4.3. Portal Materials may only be used under the terms specified in the license and upon obtaining appropriate approval from Caritas Ukraine.
2.4.4. When using Portal Materials, it is necessary to indicate that the copyright belongs to Caritas Ukraine and provide a hyperlink to the safeguarding portal https://www.safeguarding.caritas.ua. For publications on the Internet, a hyperlink is mandatory.
2.4.5. Portal users may download or copy Portal content, other components and elements displayed on the Portal, only for personal use, provided that all copyrights and other notices contained therein are respected. Copying or storing any content for purposes other than personal use without the prior written consent of Caritas Ukraine is strictly prohibited.
2.4.6. Portal Materials can only be used in the following ways: personal use, distribution of copies, distribution of hyperlinks, public display, public performance. Portal Materials can only be used in their entirety.
2.4.7. Use of information means any reproduction, republication, distribution, processing, translation, inclusion of its parts in other works, and other methods provided by the Law of Ukraine “On Copyright and Related Rights”.
2.4.8. Caritas Ukraine grants written permission to use its materials at its sole discretion based on an electronic request to secretary@caritas.ua with mandatory indication of a return email address. Caritas Ukraine reserves the right, in the process of considering the request, to demand any additional information from third parties necessary to make a decision on issuing written permission.
3. Registration
3.1. Registration on the Portal is available exclusively to employees of the Caritas Ukraine network who are designated as Persons responsible for implementing the Safeguarding system in Caritas Ukraine network member organizations.
3.2. As part of the registration or account creation process, Portal users create login credentials by choosing a password and providing a corporate email address. All user information provided during registration must be accurate and up-to-date.
3.3. Each registration is valid for one user. Users may not (a) share their registration login credentials with others, (b) choose or use another person’s credentials for the purpose of impersonating that person, (c) use account data without the owner’s permission. Failure to comply with the above provisions is considered a violation of the Rules, and Caritas Ukraine may cancel or suspend access to the Portal for users who commit such violations.
3.4. The Portal user is personally responsible for maintaining the confidentiality of the password, which should not be disclosed to any representative of Caritas Ukraine or member organizations of the Caritas Ukraine network.
4. Personal data and confidentiality
4.1. Information on the collection, processing and protection of personal data of Portal users is defined in the Data Collection and Processing Notice and is an integral part of these Rules.
5. Disclaimer
5.1. Caritas Ukraine and Caritas Ukraine network member organizations do not guarantee and are not liable for the usability of Portal Materials, their suitability for any specific purpose, without infringement of anyone’s rights, regarding the use of this Portal, its content (including user content). Caritas Ukraine and Caritas Ukraine network member organizations do not guarantee that (a) the Portal will meet user requirements; (b) the Portal will function uninterrupted, regularly, securely or without errors, or that (c) the results that may be obtained from the use of the Portal (including any content, information and materials on the Portal) will be correct, complete, accurate, reliable or otherwise meet user requirements and expectations.
5.2. Downloading or any other acquisition of materials from the Portal is carried out by the user at their own discretion and with awareness of their own responsibility, particularly regarding the integrity and proper functioning of their own computer systems and devices.
5.3. Caritas Ukraine and Caritas Ukraine network member organizations are not liable for any indirect, incidental, consequential, intentional, accidental or other damages arising from or in connection with access, use or inability to access, use of the Portal and the materials placed on it. Except in cases where harm was caused by fraud or deliberate misleading committed by an employee of Caritas.
6. Other Terms
6.1. These Rules apply in accordance with the legislation of Ukraine. Any disputes regarding the implementation of these Rules will be resolved by the appropriate court, in the manner determined by the current legislation of Ukraine.
6.2. Portal Materials may contain links related to other internet sites, resources and organizations. Caritas Ukraine is not responsible for the availability of such external resources or their content. In case of doubt regarding any external link, please contact the administrator of such website.
6.3. Caritas Ukraine has the exclusive right to terminate the operation of the Portal or any part thereof at any time and for any reason without prior notice or agreement.
